Terms Of Service
THE COOFFICE by Guido Del Fante - Via Della Libertà 57/D - 51031 Agliana (PT) - VAT number 01908550476 hereinafter also referred to as the "grantor" in order to proceed with your registration to the platform, informs you as follows. Your person with the correctly entered data will be referred to as "user" or "contractor" below.
Background
that the grantor has dedicated spaces for services, work, courses, and similar activities called "Cooffice Agliana" located at Via della Libertà 57/D in Agliana;
- that the grantor offers ample space and types of space for workers and associations of all kinds;
- that the contractor is interested in using workstation services, common areas, and common services identified in this contract;
- that the contractor undertakes not to sublet or transfer to third parties the right to use their workstation and the related services;
- that the equipment such as desks, chairs, other furniture, rental equipment, and the entire property are owned by GDF SERVIZI DI GUIDO DEL FANTE;
Having regard to the above, the parties agree as follows:
The grantor grants the user the use of the COoffice Agliana headquarters, located at Via Della Libertà 57/D Agliana in the province of Pistoia, named The Cooffice Agliana. Limits are provided on the use of the service.
USER'S RESPONSIBILITIES
By accepting these conditions, the user:
- Takes responsibility for any damage caused to the equipment, premises, or areas owned by GDF SERVIZI DI GUIDO DEL FANTE;
- Assumes responsibility for the services and amounts chosen;
- Assumes responsibility for the actions of guests or visitors who visit the facility. It will be mandatory to have guests sign the attendance register at reception;
- Assumes responsibility for the loss, misplacement, breakage, or similar events related to the rented product used inside or outside COoffice Agliana, reimbursing GDF SERVIZI DI GUIDO DEL FANTE the full amount including VAT of the rented product;
- Assumes responsibility for the loss or misplacement of personal items such as laptops, tablets, smartphones, etc. By signing this contract, the user releases the grantor from any liability for theft or damage that may occur to their equipment or furniture inside COoffice Agliana and the parking area;
- Commits not to leave money, notebook, or other valuable or personal items at the workstation inside COoffice Agliana, expressly relieving GDF SERVIZI DI GUIDO DEL FANTE from any responsibility in case of theft, burglary, fire, damages due to force majeure and inclement weather, relinquishing any claims for damages;
- Agrees that with the delivery of keys and electronic badge, all maintenance or necessary care for the property will be the user's responsibility;
- Declares to release the grantor from any liability arising from improper or illegal use of software installed on the user's computer without a proper license;
- Declares to release the grantor from any liability resulting from improper or illegal use of the internet connection by the user;
- Commits to conduct lawful activities inside the premises of COoffice Agliana, maintain a respectful and collaborative attitude towards other collaborators;
- Commits to respect the privacy of other collaborators, avoiding the use or observation of material and devices not owned by them;
- Commits to enforce the above rules to all external guests in case of using the meeting room. In case of damages or similar events, the user will be held responsible;
- Commits to switch off air conditioning systems, lights, and other power devices when not present in the office. If the user leaves the tools on in their absence, they will be charged for each hour the tools are left on unnecessarily at a rate of 10 euros per hour;
- Commits not to lose keys and access badges. In case of loss or theft, the user will be required to pay 50 euros to GDF SERVIZI;
- Commits to comply with the facility regulations communicated and continuously updated. It is mandatory to keep the phone on silent mode and use low voice tones.
GRANTOR'S RESPONSIBILITIES
The grantor is responsible for the operation and access to the COoffice Agliana facility and its maintenance. However, the grantor is not responsible for:
- Actions carried out by users or third parties inside the facility or in the parking lot of COoffice Agliana;
- Illegal use of software by users of COoffice Agliana;
- Theft, breakage, or loss of personal or work items of users inside COoffice Agliana;
- Activities aimed at tax evasion by users of COoffice Agliana;
SPACE OPENING HOURS
COoffice Agliana will be open from Monday to Friday, from 8:30 am to 7:30 pm, with a reception service at varying hours which will be communicated accordingly, except for:
- Organizing events, courses, or similar activities during evening hours;
- On holidays, namely January 1st and 6th, April 25th, May 1st, June 2nd, August 15th, November 1st, and December 8th, 25th, 26th, and 31st, including communication of other holidays;
- In case of lack of staff or similar situations, access to the facility will be guaranteed through badges and/or a web app, but not the reception services.
RESERVATION
The CoArea Basic and CoArea Pro coworking space service, private offices, and/or meeting rooms, subject to availability, can be booked through the platform. Upon registration, a subscription fee of 30 euros will be charged, valid for the calendar year (from January to December). The user must independently top up their credit within the app.thecooffice.com application and then proceed with the purchase of selected services. The Meeting Room can be booked at any time subject to availability. The reservation will be confirmed if the room is available and there is sufficient credit. The reservation can be canceled up to 2 hours before the scheduled time. No refunds will be available for used credit. Upon purchasing credit, a receipt will be issued with the user's details. The Cooffice Agliana will not be responsible for any incorrect data provided at the time of registration.
WITHDRAWAL AND CONTRACTUAL NOTES
It is possible to cancel at any time from the platform by requesting cancellation from the menu or via email to info@coofficeagliana.it or via pec at guido.delfante@widipec.it. Upon cancellation, unused credits will not be refunded, and the user cannot request any refunds. These indications apply to profiles without a contract. Different clauses may apply in the case of a contract.
JURISDICTION
For any dispute between the parties, the jurisdiction of the court where the granter is located is exclusively competent.
PRIVACY
Under and for the purposes of Art. 1341 c.c., I declare that I have read the entire contract and specifically approve and accept Articles 2 and 3 (limitation of liability) and 4 (right to withdraw) by signing at the bottom. Pursuant to Art. 7 of Legislative Decree 196/2003 and Art. 13 of GDPR Regulation EU 2016/679, by signing, I authorize the grantor, in compliance with the law, to collect data that may be monitored by the supervisory authority and used anonymously for statistical purposes. The interested parties have the right to exercise the rights provided in Art. 7 of Legislative Decree 196/2003. The data necessary for service and billing purposes cannot be deleted. After receiving the above information, by signing I consent to the processing of my personal data.
